WAIVER OF LIABILITY

Agreement:  Becoming a participant of the Zion Yoga Fest, by signing up for the Zion Yoga Fest, (or any Zion Yoga Fest event) and purchasing a ticket, and attending.  Participant (client) confirms that they have read this agreement, understand it and agree to it.

• The opinions, services, and instruction being offered by Zion Yoga Fest, LLC. or it’s instructors, are not medical advice, consultation, therapy or treatment.  I understand that the educational services and instruction provided are not intended to be used in place or in lieu of any medical advice or treatment that I may require for any cause whatsoever now or in the future.
• No representatives or statements that have been made to me in regards to the services or instruction that may be provided and no guarantee has been made to me in regards to expected results or a cure of any kind for any medical condition, nor are any of the instructors considered or trained as such therapists.
• It is my responsibility to consult with a physician prior to my participation in the group classes and workshops offered. I represent and warrant that I am physically fit and have no medical or mental condition which would prevent my full participation in classes.
• Yoga requires physical exertion which may be strenuous and I specifically agree that Zion Yoga Fest , LLC. and all instructors or substitutes or all subordinate or affiliated people or organizations shall not be liable for any claim, demand, cause of action of any kind; on account of death, personal injury, property damage or loss relating to or from the participants use of the facilities in anyway.
• Engagement in movement and classes is done at my own risk. I assume all risk and full responsibility of injury, illness, damage or loss to my person or property that might result. I will not hold Zion Yoga Fest, LLC liable for injury, illness, damage or loss to my person or property that might result from participation.
• I understand that my behavior in class must be appropriate, otherwise I may be asked to leave with no refund issued.
• I give Zion Yoga Fest, LLC. and its instructor’s permission to use my photo, video, and audio taken of me while participating at Zion Yoga Fest, LLC. events, IN PERSON AND ONLINE for promotional material, published material, re-watch class and workshop material both in print and on the web.  I understand that my face, body, and anything I say or ask or participate in at Zion Yoga Fest, LLC will and can be recorded or documented and available in print and on the web.  I give permission to Zion Yoga Fest, LLC to publish said media and understand they own the rights to said media and will not hold Zion Yoga Fest, LLC liable for any disputes or events that happen from the publication of such material.
• By purchasing and participating at any Zion Yoga Fest event I agree to not bring, distribute, or use any illicit drug or illegal substance during said event.

In the event of a legal dispute, participant agrees to pay for the costs and attorney fees of Zion Yoga Fest , LLC
In the event of a legal dispute, participant agrees that the dispute must be resolved through arbitration and that its sole and exclusive venue shall be in Washington County, in the State of Utah.
I, my heirs or legal representatives forever agree to release and discharge all instructors, officers and agents of Zion Yoga Fest, LLC. and their assigns from any and all claims or causes of action known or unknown arising out of any act of negligence arising from my participation in their courses. I acknowledge I have read this agreement and fully understand its contents.
